Terms and Conditions for Ferren Ltd Bathroom Design Services

Effective Date: 18th June 2026

These Terms and Conditions ("Agreement") govern the relationship between Ferren Ltd, trading as Ferren Bathrooms, referred to as "the Company", "we", "us" or "our", and the client ("Client", "you" or "your") who purchases or engages our bathroom design services through our website or otherwise. By placing an order, paying a fee, approving a proposal, or instructing us to begin work, you agree to these terms.

1. Scope of Services

1.1 Bathroom Design Service: We provide bespoke bathroom design services tailored to the information, preferences, measurements and property details supplied by the Client. The service may include layout planning, 3D visualisations, product ideas, finishes guidance, specification notes, and other design documents as described on our website, proposal, invoice or order confirmation.

1.2 Design Deliverables: The specific deliverables included in your package will be those set out at the point of purchase or in our written proposal. Unless expressly stated otherwise, drawings, plans, visualisations, product schedules and specification notes are design documents only and are not technical construction drawings, measured surveys, structural drawings, building control drawings or installation instructions.

1.3 Product Specification and Sourcing Guidance: We may recommend or specify products, materials, fixtures and fittings for the design. Any product links, schedules, estimated prices or supplier details are provided for guidance only, no procurement is provided. Product availability, prices, delivery times, specifications and supplier terms may change.

1.4 Contractor Match Service: As part of the design service, we may, where appropriate, introduce or match the Client with a  trusted independent bathroom installer who may be suitable to quote for and carry out the installation of the design. This is an introduction service only.

1.5 No Installation by Ferren Ltd: Ferren Ltd does not employ, appoint, supervise or manage the installer or contractor as part of the design service. Any installation, building works, site management, health and safety arrangements, programme, access, labour, materials ordering, site measurements, warranties, snagging or aftercare relating to the works are the responsibility of the contractor and/or the Client under a separate agreement between them.

1.6 Changes to Services: We may make reasonable changes to the way we deliver the design service where necessary to improve the service, comply with law, reflect supplier or software changes, or respond to information provided by the Client.

2. Contractor Match Service

2.1 Independent Contractors: Any installer or contractor introduced through the Contractor Match Service is an independent third party. Ferren Ltd does not employ, appoint, supervise, direct, control, monitor or manage the contractor or their work. Ferren Ltd does not carry out installation, building, plumbing, electrical, tiling, waterproofing, ventilation, waste removal, site management, health and safety supervision, snagging or aftercare services unless expressly agreed in a separate written contract signed by Ferren Ltd.

The Client acknowledges that any agreement for installation or building works is made directly between the Client and the contractor. Ferren Ltd is not responsible for the contractor’s quote, scope of works, programme, payment terms, workmanship, defects, delays, failure to complete, conduct, insurance, regulatory compliance, health and safety obligations, warranties, or any acts or omissions of the contractor.

The contractor will provide their own quote, terms, insurance details, programme, warranties and contract documents directly to the Client.

2.2 Separate Contract: If you choose to proceed with a contractor introduced by us, your contract for installation or building works will be directly between you and that contractor. Ferren Ltd is not a party to that contract and is not responsible for the contractor's acts, omissions, advice, pricing, delays, workmanship, defects, site conduct, insolvency, insurance, health and safety compliance or warranty obligations.

2.3 No Guarantee of Availability or Acceptance: As part of the Contractor Match Service, we will use our best endeavours to introduce you to a trusted independent installer who may be suitable for your project. However, we do not guarantee that any contractor will be available, willing to quote, able to meet your desired timetable, or able to carry out the works within your budget. The contractor may decline the project or may propose changes to the design for practical, technical, regulatory or cost reasons.

2.4 Client Checks: The Client is responsible for carrying out their own checks before instructing any contractor, including reviewing the contractor's quote, terms, insurance, qualifications, references, payment schedule, scope of works, exclusions and warranty arrangements.

2.5 Design Familiarity: We may share relevant design documents with an introduced contractor to help them understand the project, but this does not make Ferren Ltd responsible for the contractor's interpretation, pricing or installation of the design.

3. Client Responsibilities

3.1 Accurate Information: The Client must provide accurate measurements, photographs, videos, plans, survey information, service locations, property details, restrictions, budget guidance and any other information reasonably requested by Ferren Ltd. We are entitled to rely on information supplied by the Client.

3.2 Site Surveys and Measurements: Unless expressly included in your package, Ferren Ltd does not carry out a measured site survey. The Client and/or appointed contractor is responsible for verifying all dimensions, levels, service routes, access constraints and site conditions before ordering products or commencing installation.

3.3 Approvals: The Client must review design proposals, product schedules, drawings and other documents promptly and notify us of any errors, omissions, concerns or requested amendments before approving them or sharing them with contractors.

3.4 Permissions and Restrictions: The Client is responsible for identifying and obtaining any landlord, freeholder, building management, planning, listed building, building control, party wall, insurance, mortgage lender, lease or other permissions required for the proposed works.

3.5 Budget and Feasibility: The Client is responsible for deciding whether the design, proposed products and contractor quotes are affordable and suitable. Any budget figures provided by Ferren Ltd are indicative unless expressly confirmed in writing as fixed.

3.6 Suitability for Installation: The Client and appointed contractor are responsible for confirming that the design can be safely and lawfully installed at the property, including plumbing, drainage, ventilation, electrics, waterproofing, structural suitability and compliance with applicable regulations.

4. Design Process, Revisions and Timelines

4.1 Process: The design process may include onboarding, information gathering, design development, Client feedback, revisions and delivery of final design documents. The precise process will depend on the service package purchased.

4.2 Client Feedback: The Client must provide consolidated feedback within a reasonable time. Delayed, incomplete or inconsistent feedback may delay the service and may affect the quality or relevance of the design deliverables.

4.3 Revisions: The number of revisions included will be as stated in the relevant service package or proposal. Additional revisions, major changes in brief, layout changes after approval, or requests outside the agreed scope may be charged at our then-current rate or quoted separately.

4.4 Timelines: Any delivery timescales are estimates unless expressly stated to be fixed. We will use reasonable efforts to meet estimated timelines, but we are not liable for delays caused by Client response times, missing information, supplier information, contractor input, illness, technical issues or events outside our reasonable control.

4.5 Expiry of Design Stage: If the Client does not provide required information, feedback or approvals for more than 30 days after request, we may pause the service. If the pause continues for more than 90 days, we may treat the service as cancelled by the Client and retain sums due for work carried out.

5. Pricing and Payment

5.1 Fees: Fees for the design service are those shown on our website, proposal, invoice or order confirmation at the time of purchase. Fees are payable in accordance with the payment terms stated at checkout or in the proposal.

5.2 Payment Before Work Starts: Unless otherwise agreed in writing, payment is required before we begin the design service.

5.3 Late Payments: Payments are due within 2 days of invoice unless otherwise stated. Any overdue payments may incur interest at 1% above the Bank of England base rate per month or part month. We may pause work and withhold deliverables until overdue sums are paid.

5.4 Taxes: Prices are inclusive or exclusive of VAT as stated at the point of purchase or on the invoice.

5.5 Contractor Costs Excluded: Contractor quotes, installation labour, building works, materials, delivery, parking, permits, waste removal, specialist surveys, building control fees and third-party costs are not included in Ferren Ltd design fees unless expressly stated in writing.

6. Online Orders, Cancellation and Refunds

6.1 Website Purchases: Where you purchase the service through our website, the order is accepted when we issue an order confirmation or begin providing the service, whichever happens first.

6.2 Consumer Cooling-Off Rights: If you are a consumer purchasing online, by phone or away from our premises, you may have a legal right to cancel within 14 days of the contract being made. To cancel, you must notify us clearly in writing.

6.3 Starting Work During the Cooling-Off Period: If you ask us to begin the design service during the 14-day cancellation period, you agree that we may start work immediately and you may be required to pay for the services supplied up to the point of cancellation. If the service is fully performed within the cancellation period at your request, you acknowledge that your right to cancel may be lost once the service has been completed.

6.4 Bespoke Design Work: Our design service is personalised to your project. Fees are non-refundable to the extent that design work, consultation time, research, drawings, visualisations, specifications or other services have already been provided or committed.

6.5 Refunds Outside Legal Cancellation Rights: Refunds outside any legal cancellation rights are at our discretion and will take account of work already carried out, third-party costs incurred, scheduled design time, and whether deliverables have been issued.

6.6 Business Clients: If you are purchasing as a business, statutory consumer cancellation rights do not apply.

7. Products, Suppliers and Procurement

7.1 Product Recommendations: Product recommendations are based on design intent, information available to us and Client preferences at the time of selection. The Client and/or contractor must check all product dimensions, specifications, suitability, compatibility, installation requirements, delivery dates and warranties before purchase.

7.2 Third-Party Products: Ferren Ltd is not responsible for the quality, performance, availability, delivery, defects, warranties, returns or aftercare of products supplied by third-party retailers, manufacturers or suppliers.

7.3 Price and Availability Changes: Product prices, stock levels, delivery charges and lead times may change. Any schedules or estimates we provide are indicative only until confirmed by the relevant supplier at the time of purchase.

7.5 Client-Supplied or Contractor-Supplied Products: Ferren Ltd accepts no responsibility for products purchased by the Client or contractor, including errors, late delivery, missing components, incorrect quantities or incompatibility with site conditions.

8. Intellectual Property and Use of Designs

8.1 Ownership: All designs, drawings, plans, layouts, visualisations, specifications, schedules, documents, concepts and related materials prepared by Ferren Ltd remain the intellectual property of Ferren Ltd unless expressly agreed otherwise in writing.

8.2 Client Licence: Once all sums due have been paid, the Client is granted a non-exclusive, non-transferable licence to use the final design documents solely for the purpose of obtaining quotes for and carrying out the bathroom project at the property identified in the design brief.

8.3 Sharing with Contractors: The Client may share final design documents with contractors and suppliers for the purpose of quoting for or carrying out the project at the property. The documents must not be copied, resold, adapted for other properties, published, or used for unrelated projects without our prior written consent.

8.4 Draft Designs: Draft concepts, rejected options and preliminary materials must not be used for installation or shared as final design documents unless we expressly confirm otherwise.

9. Design Renders, Drawings and Practical Limitations

9.1 Illustrative Nature: 3D renders, sketches and visualisations are illustrative only. Colours, textures, scale, lighting, reflections, grout lines, tile setting out, finishes and product appearances may vary in real life and between screens, samples and production batches.

9.2 Not Technical Construction Documents: Unless expressly agreed in writing, our drawings and design documents are not architectural, structural, engineering, M&E, electrical, plumbing, waterproofing, building control or construction-detail drawings.

9.3 Site and Installation Variations: Installation may require changes due to unknown site conditions, hidden services, drainage falls, joists, walls, ventilation routes, product tolerances, regulation requirements, contractor methods or other site conditions. Ferren Ltd is not responsible for such changes.

10. Liability

10.1 Reasonable Care and Skill: We will provide the design service with reasonable care and skill.

10.2 Liability Cap: To the maximum extent permitted by law, Ferren Ltd's total liability to the Client arising out of or in connection with the design service is limited to the total fees paid by the Client to Ferren Ltd for the specific design service giving rise to the claim.

10.3 Exclusions: Ferren Ltd is not liable for indirect, consequential or incidental losses, loss of profit, loss of enjoyment, loss of opportunity, contractor costs, remedial works, delay costs, product defects, supplier delays, installation defects, or losses arising from third-party acts or omissions, except where such exclusion is not permitted by law.

10.4 Nothing Excluded Illegally: Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

11. Cancellation, Suspension and Termination

11.1 Client Cancellation: If the Client cancels after instructing us to begin work, the Client remains liable for all work carried out, time allocated, third-party costs incurred and fees that have become due up to the date of cancellation.

11.2 Company Suspension or Termination: We may suspend or terminate the service if the Client fails to pay, fails to provide information or feedback, behaves abusively, requests unlawful or unsafe work, breaches these terms, or makes it impractical for us to continue.

11.3 Effect of Termination: On termination, we may invoice for work carried out and costs incurred. We may withhold final deliverables until all outstanding sums are paid.

12. Photography, Marketing and Case Studies

12.1 Design Materials: We may use non-confidential design images, renders, drawings and project descriptions in our portfolio, website, social media and marketing materials unless the Client requests otherwise in writing before publication.

12.2 Completed Project Images: If the Client or contractor provides photographs or videos of the completed bathroom, the Client grants Ferren Ltd permission to use those images for portfolio, website, social media and marketing purposes, provided we take reasonable care not to disclose personal data or identifying property details without consent.

13. Data Protection and Communications

13.1 Personal Data: We will process Client personal data in accordance with our privacy policy and applicable data protection law.

13.2 Communications: We may communicate with the Client by email, phone, video call, messaging applications or project management tools where appropriate for the service.

13.3 Sharing with Contractors and Suppliers: Where necessary to provide the design service or contractor match service, the Client authorises us to share relevant project information and design documents with introduced contractors and suppliers.

14. Miscellaneous

14.1 Entire Agreement: These terms, together with the relevant proposal, invoice, order confirmation and website service description, form the entire agreement between Ferren Ltd and the Client for the design service.

14.2 Severability: If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

14.3 Force Majeure: Neither party will be liable for failure or delay in performing obligations caused by circumstances beyond their reasonable control, including but not limited to illness, supplier disruption, technology failure, extreme weather, acts of government, strikes or other events outside reasonable control.

14.4 Assignment: The Client may not transfer or assign the agreement without our prior written consent. Ferren Ltd may assign or subcontract administrative or specialist elements of the design service where appropriate, but remains responsible for the design service we provide.

15. Governing Law and Disputes

15.1 Governing Law: This Agreement is governed by and construed in accordance with the laws of England and Wales.

15.2 Courts: The courts of England and Wales will have jurisdiction over any dispute arising out of or in connection with this Agreement.

By purchasing or engaging Ferren Ltd for bathroom design services, you acknowledge that you have read, understood and agreed to these Terms and Conditions.
